Opinion | Arvind Kejriwalās āspecial privilegesā should be every prisonerās right
"This is not the moment to ask why certain facilities are being made available to the CM but to question why all prisoners aren’t provided these facilities as a norm. Access to medication for diabetes, a pen, paper, a television, medical staff, books — they are at best classified as “basic”, not “special”. Then why are other prisoners denied such basic amenities when it is a long-established principle of penology that prisons are places where people are sent “as” punishment and not “for” punishment?" writes Madhurima Dhanuka.

Why has Arvind Kejriwal been allowed to keep toffees with him in Tihar jail?
Chief Minister Arvind Kejriwal who has been lodged in Tihar Jail after being arrested by the Enforcement Directorate in an excise policy-linked money laundering case, has been allowed to keep toffees with him in the cell. According to a PTI report, officials saw Kejriwal keeping devices like a sugar sensor and glucometer, along with isabgol, glucose, and toffees on his table. The report further noted that the court had directed jail authorities to allow Kejriwal, a diabetic, to carry these items to be used in case of a sudden dip in his sugar levels.
AAP leader Atishi took to X to write that Kejriwal has lost 4.5 kg since he was arrested on March 21, which is very “worrying”. “Arvind Kejriwal is a severe diabetic. Senior advocate Abhishek Manu Singhvi for Delhi CM begins his rejoinder
“My friend doesn't describe one thing which the petition is and labels everything that it is not… the petition remains one challenging illegal arrest under section 19 PMLA. To bring in deliberate issues of bail quashing is uncalled for…”
“The same argument which the ED suffered the rejection of in Pankaj Bansal has now been raised.”
Singhvi tells the court that the review petition against Pankaj Bansal has been dismissed.
“The cognizance happened one and half years ago what relevance does it have to my (Arvind Kejriwal) arrest which happened around 10 days ago? How is it of any relevance under section 19 arrest petition?”
Arvind Kejriwal Arrest Live Updates: Kejriwal was arrested for his role in dual capacity, says Additional Solicitor SV Raju
“Our case is that he was arrested for his role in a dual capacity. He is involved individually which is clear from the approver statements. In his role in policy formulation.”
“We have WhatsApp chats and hawala operators its not as if we are shooting in the dark…We have large amounts of income tax data also…”
Delhi HC- “Before I reserve I would like to see the files…”
Raju- “A person can be accused if he is involved in the offensive. If somebody else has committed an offence like a company then you can't be held responsible unless there is provision of vicarious liability. This is found in Section 70 PMLA. We have established that evidence shows that kickbacks were used for the election campaign of AAP in Goa. The beneficiary was AAP.”
“Our case is AAP is an association of individuals…A Company’s definition is widened for section 70 PMLA. You may not be a company strictly but may be deemed to be a company if you are an association of people…”

Arvind Kejriwal Arrest Live Updates: Raju reads Manish Sisodiaās SC judgment arguing about clear-cut case of money laundering recognised by the SC
“Vijay Nair worked in the camp office of Kejriwal. Lived in a govt bungalow allocated to Kailash Gehlot and it was near Kejriwal’s home.”
“There was one Mahadev liquor L1 wholesaler in Delhi. He did not agree to give kickbacks but he was forced to do so…A person who made a complaint against Indospirit for cartelization was asked to take back his complaint.”
“The ‘new excise policy’ was meant to give gains to a few whole sellers. Those who didn't give kickbacks were asked to surrender licenses so that those being favoured be given spaces…The existence of kickbacks flawed the policy, of a scam that has been accepted right to the Supreme Court.”
“It is not as if ED has become active now during the elections. It has been working all along. ED has been active for many years.”
“You act through middle man so you don't come in the picture. The attitude is I'm a saint I didn't do anything. Very tactically very smoothly this has been done…their argument is ‘mere ghar se kuch nahi mila…inhone kisi aur ko de diya toh kahan se milega inke ghar se kuch bhi’. Finding the actual proceeds of crime is irrelevant if we make out a case that you were involved in money laundering…The fact that there was a scam is beyond doubt, however, hue and cry you make.”

Arvind Kejriwal Arrest Live Updates: Additional Solicitor SV Raju refers to judgments on 'cognizance of offences'
“A large number of accused have been refused bail by the trial court high court and Supreme Court in this money laundering case. In a money laundering case, one of the reasons for rejecting bail is a prima facie opinion of guilt of money laundering against the accused.”

Arvind Kejriwal Arrest Live Updates: "Cognizance orders have not been challenged?" Delhi HC asks to ED
“Today a person is arrested and remanded to police custody for five days. Petition filed against it. Thereafter he has been sent to judicial custody. So even if the first two orders are set aside, he won't come out because his custody in subsequent orders has not been challenged or set aside.”
“This is a bail petition under the guise of a writ. He could not have moved his bail application when he was in ED or police custody. To obviate it he filed a writ petition challenging the arrest to overcome the rigours of section 45 PMLA.”
“The fact that a money laundering offence has taken place is clear and beyond any doubt,” said Raju. He points to dates of orders where cognizance of ED’s complaints took place. Cognizance is always of the offence and not of the offender” Raju said.
"Cognizance orders have not been challenged?" Delhi HC asks to ED
“No. There is a categorical finding that an offence has taken place. All five prosecution complaints cognizance has been taken.” “Cognizance would indicate that there is a prima facie case for trying the accused. PMLA offence, money laundering offence made out, the trial is to be conducted, that's what cognizance indicates.”
“A Prima facie case has been made for the commission of money laundering offence as per the five cognizance orders.”
Arvind Kejriwal Arrest Live Updates: Kejriwal is not entitled to any relief, says Additional Solicitor SV Raju
“Their case here is that remand is bad. But in the second remand (March 28) order he voluntarily accepts please remand me. He can't blow hot and cold at the same time. Can he challenge this remand order? Or is it barred by waiver or acquiescence? He has not challenged the latest orders in the absence of it custody can't be set aside.”
“Even if the earlier order is bad unless a subsequent order is challenged and set aside, Kejriwal is not entitled to any relief. “ On April 1 Kejriwal was sent to judicial custody till April 15 by Rouse Avenue Court.
“The first prayer in his petition is akin to a habeas corpus prayer if you pierce the veil.”

Arvind Kejriwal Arrest Live Updates: Section 70 of PMLA used wrongly, Delhi CM's lawyer says
Delhi CM Arvind Kejriwal's lawyer, Singhvi said, "Section 70 PMLA has been falsely, inaccurately and wrongly used. This is complete vicarious liability. Please don't allow it to happen. Section 70 cannot applied, it is specifically for companies. AAP is registered under Representation of People Act then different statute cannot be subsumed in the heading of the company under PMLA. There has to be a specific role of the petitioner even for a company which I am denying. There has to be knowledge, due diligence on his part.
Additional Solicitor General S V Raju objected to senior advocate Amit Desai appearing for Kejriwal. Raju said, "There cannot be two lawyers for him. Just because he is powerful and can afford them. No aam admi is entitled to more than one advocate. Why is he is an exception ? You maybe powerful and rich and claim to be aam aadmi but you cant have more than one lawyer."

Arvind Kejriwal Arrest Live Updates: Magunta's father joined ruling party's alliance after giving statement against Kejriwal, Delhi CM's lawyer
Singhvi points to Raghav Magunta’s statements- In criminal law if you see basic principles of fairness it is fraudulent by prosecutor to say that I’ll keep the documents simply...unrelied and avoid scrutiny by court. It is against elements of fair play.
Because there is a quid pro quo about approvers giving them bail and thereafter joining a political party. You are given an absolute bail hardly 10 days later after statement. These are volte fast, absolutely contrary statements- this is making a joke of accused rights making a joke of fair play.
He then refers to Magunta’s father’s statement- “the father made the statement obviously to secure bail for his son. This statement is contrary to his earlier statements”. Singhvi also said Magunta's father joined an alliance of the ruling party after giving statements against Kejriwal.
Raghav Magunta Reddy, son of a YSR Congress Party MP, and businessman Dinesh Arora, both accused in the excise policy case, were approvers in the money laundering case being investigated by the Enforcement Directorate (ED).

Arvind Kejriwal Arrest Live Updates: No material supporting PMLA, Kejriwal's lawyer argues before HC
Pressing on the level playing field argument, Arvind Kejriwal's advocate, Singhvi said, "What is this urgency on the level playing field argument. In Indra Gandhi v Raj Narayan (SC) case, free and fair elections were held part of basic structure. The timing here suggests a clear unconstitutional element of the whole action." Elucidating the second point, Singhvi said, "this case is unique as there is no material of any matter supporting under section 50, PMLA. The first summons was sent on Oct 30, 2023. Ninth summons was sent on March 16, this year and between this period six months or so have passed. You (ED) are clearly arresting without enquiry/material which can form the basis of the arrest. "

Arvind Kejriwal Arrest Live Updates: Delhi BJP sends defamation notice against Atishi after Minister claimed BJP threatened her to join party
After AAP leader and Delhi Minister Atishi claimed that the BJP approached her to join the saffron party, BJP's Delhi unit sent a defamation notice against her. The BJP demanded a public apology for her claim, PTI reported.
"Atishi failed to provide evidence of who approached her, how and when. The AAP is undergoing a crisis in Delhi, which is why they are making such baseless allegations out of frustration. But we will not let her get away with this," Delhi BJP chief Virendra Sachdeva said in a press conference. Sachdeva chief asked Atishi to submit her phone to an investigation agency to prove her claim.
Atishi alleged on Tuesday that the BJP and the Enforcement Directorate (ED) are targeting her, besides Health Minister Saurabh Bharadwaj, MLA Durgesh Pathak, Rajya Sabha MP Raghav Chadha and want to arrest them. The minister further said she was “threatened” to join the BJP if she did not wish to be arrested within the next month.
Accusing the saffron party of trying to topple the AAP and the Delhi government, she said, “After arresting four of our senior leaders – Satyendar Jain, Manish Sisodia, Sanjay Singh and Chief Minister Arvind Kejriwal – the BJP is conspiring to arrest four more leaders of the AAP. They (BJP) thought AAP will fall with the arrest of CM Arvind Kejriwal and the senior leadership. Now as they found it is not going to happen, they are targeting us.”

āKeep location on if travelling outside NCR, share details with investigating officerā, court tells Sanjay Singh
Among the conditions set for his bail, a Delhi court said that Sanjay Singh will have to inform the investigating officer (IO) of his whereabouts if he travels outside of the national capital region (NCR).
The court had earlier directed that Singh would not leave the NCR without permission, however, his counsel intervened saying he would have to campaign at various places for the upcoming Lok Sabha elections. “In that case, if he must leave NCR, he will share a detailed itinerary with the IO and will have to keep his location on at all times,” the court said.
The hearing is ongoing at the Rouse Avenue Court. The court has set the bail bond at 1 lakh and 1 lakh in surety.
Singh’s bail conditions include: he will not tamper with the evidence, he will provide mobile number to the IO and he will join the investigation, and he will follow the condition imposed by the Supreme Court.
